Introduction
We want your decision to use Recompensa to pursue your claim to be the right decision for you. We are committed to providing a professional, simple to understand and easy to use service. We pride ourselves for being completely transparent in all our dealings with you and these T&C’s explain our obligations and commitments to you and yours to us. They will be at the core of our relationship, and our contract with you. Please take your time to read them carefully.
We are confident you will be completely satisfied with our service, but if you should have any reason to complain please do not hesitate to contact us. You can contact us via email claims@recompensa.co.uk to raise a complaint or request a copy of our complaint’s procedure.
Definitions
Recompensa Ltd is a limited liability company and a third-party claims handler registered in England and Wales with No. 13741991 trading from Fairfield Court, Chesterfield, Derbyshire, S42 7PT.
“Services” means the services provided by Recompensa Ltd including assessing the viability of, preparing, submitting and resolving your claim.
“Settlement” means (but is not limited to) anyone or more of the following or a combination of them:
“Fee” means the fee payable to Recompensa for services being 30% of any settlement received to us on your behalf. For example, if we obtain a refund of £250, our fee would be £75. Once payments have cleared Recompensa Ltd will make payment to you via bank transfer or cheque less fees. If your claim is unsuccessful we will advise you either in writing or by email and there will be no costs occurred for you.
“We” and “us” refers to Recompensa Ltd or anyone whom we transfer our obligations and right under this agreement.
“You” means you, the individual entering into this agreement.
1. By signing (including E-sign) the Letter of Authority you will:
1.1 Be accepting these Terms and Conditions and entering into a legally binding contract:
1.2 You agree for the settlement is to be sent directly to us and that we will retain our Fee before paying the balance of the settlement to you. Should the settlement be paid direct to you or credited to an outstanding credit agreement, bank account or credit card we will invoice you direct for the Fee which will become immediately due and payable to us. If this Fee is not paid in full within 14 days of the dated invoice we may commence dept collection proceedings to recover the monies owed to us.
1.3 Should you wish to cancel your claim once the contract is signed means you are required to pay a £49 admin fee and we will instruct the retailer of your decision.
2. Recompensa Ltd will:
2.1 Rely on the information and documents provided by you to us as being true, accurate and complete.
2.2 Use our reasonable endeavors to obtain settlement for the claims which are pursued.
2.3 Accept no liability for an unsuccessful claim or for the settlement. All unsuccessful claim will be passed to our legal specialist to assess legal proceedings at your request and costs. We will also report any unsuccessful claims to the Financial Ombudsman Services to investigate.
2.4 Promptly notify you if the claim is not to be pursued. We will act reasonably in taking such decisions.
2.5 Promptly notify you of the outcome of the claim.
2.6 As soon as is reasonably practical following a successful claim and the payment to us has cleared we will pay you your settlement amount less our fee.
2.7 We do not sell any of your personal information to any third parties for marketing purposes and your details are only used for the claim itself. These details can be provided if requested by email to claims@recompensa.co.uk
3. Cancellation rights:
3.1 You have 14 days (starting from the date you signed your Letter of Authority) to cancel your authority, instructing Recompensa Ltd to act on your behalf. There will be a £49 admin fee to pay.
3.2 If you cancel the contract after these 14 days, we reserve the right to charge you the fee amount in full. Your contract will only be cancelled once payment has been received.
3.3 If you withdraw a claim prior to the claim be settled yet your claim is upheld, and settlement made you will still be liable for the fee amount. This fee must be paid in full within 14 days to avoid debt recovery, additional charges and/or legal proceedings.
3.4 If you independently accept settlement based on a claim pursued by Recompensa Ltd from the company instructed to claim against you will still remain liable for the fee amount.
4. Governing Law
4.1 This contract is legally binding and is subject to the laws of England and Wales.
Declaration
I confirm that I have read and understood the Terms and Conditions (contract T&C’s) and by signing the Letter of Authority confirm acceptance of them and wish for Recompensa Ltd to act on my behalf.
